Terms of use
These terms explain how you can use MC Bridge. Please read them before you create an account or upload files. By using MC Bridge you agree to them.
1. Who we are
MC Bridge is run by Thomas Setchell, trading as MC Bridge, a sole trader based in St Ives, Cambridgeshire, United Kingdom ("we", "us"). You can contact us at hello@mc-bridge.com.
2. What MC Bridge does
MC Bridge is an online file conversion service for machine control. You upload design files (for example LandXML, DXF, DWG, Trimble, Topcon or Leica formats, and calibration files), choose a machine family and coordinate system, and MC Bridge builds files intended to be loaded on to machine-control systems. MC Bridge is a conversion tool only. It does not survey, design, set out or check your site.
3. Accounts and logins
- You need an account to use MC Bridge. You must give accurate details and be at least 18.
- Keep your password private and do not share your login. You are responsible for what happens under your account.
- Tell us straight away at hello@mc-bridge.com if you think someone else has used your account.
- If you use MC Bridge for a business, you confirm you are allowed to accept these terms for that business.
4. Plans, trials and paid subscriptions
Each account has a plan status:
- Free: access we choose to offer at no charge, which may be limited.
- Trial: full or extended access for a stated period. A trial ends on its end date unless you choose to subscribe.
- Active: a current paid subscription (or access we have granted).
- Expired: a trial or subscription that has ended. You can still log in, but conversions and downloads may be unavailable until you renew.
Paid subscriptions are not yet available. When they are, we will show the price (including any VAT), what is included, how often you are billed and how to cancel before you pay. Payments will be taken by a payment provider (we expect to use Stripe); we will not see or store your full card details. Subscriptions will renew automatically at the end of each billing period until cancelled. We will give you reasonable notice before any price change takes effect, and you can cancel before it does.
5. Cancelling and your 14-day right
- You will be able to cancel a paid subscription at any time from your account or by emailing hello@mc-bridge.com. Cancellation takes effect at the end of the current billing period, and you keep access until then. We do not refund part periods except where the law requires it.
- If you are a consumer (using MC Bridge mainly for purposes outside your trade, business or profession), the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 normally give you 14 days from the day you subscribe to cancel and get a refund. If you ask us to start the service during those 14 days and then cancel, we may deduct an amount for the service you have already used. If the service has been fully provided in that period at your request, the right to cancel may be lost.
- Business customers do not have this statutory 14-day right.
6. Checking converted files before use
Check before use. MC Bridge converts your design as supplied. Confirm levels, coordinate system and calibration on site before working to it.
In more detail:
- Conversion between formats can change, simplify or lose data. Results depend on the files, settings, coordinate system and calibration you give us.
- Before use you are responsible for checking, among other things: surface levels and linework against the original design; the coordinate system, projection, datum and geoid; site calibrations and localisations; and the file on the machine itself, including checks against known points on site.
- MC Bridge is provided "as is". We take reasonable care in providing it, but, as far as the law allows, we give no warranty that converted output is accurate, complete, or suitable for any particular machine, software version or project.
- Nothing in these terms takes away rights you have by law. If you are a consumer, the service must be provided with reasonable care and skill, as the Consumer Rights Act 2015 requires.
7. Your files
- You keep all rights in the files you upload and the files MC Bridge produces from them.
- You give us a limited, non-exclusive licence to store, process and convert your files only so we can provide the service to you, and for no other purpose. We do not sell, share or use your files to train anything.
- You confirm you have the right to upload the files and to have them converted.
- Files are deleted automatically after the period set out in our Privacy notice. Keep your own copies. MC Bridge is not a storage or backup service.
8. Acceptable use
You must not:
- upload anything unlawful, malicious (such as viruses), or that you do not have the right to use;
- try to get around logins, plan limits or security, or access other users' files;
- overload, disrupt, scrape or automate access to the service without our written permission;
- resell or provide the service to others as your own without our written agreement;
- use MC Bridge in a way that breaks the law or harms others.
9. Compatibility and trade marks
MC Bridge is an independent service. It is not affiliated with, endorsed by, sponsored by or approved by Trimble, Topcon, Leica Geosystems or any other manufacturer. Trimble, Topcon, Leica and related product names are trade marks of their respective owners. We use them only to describe which systems and file formats MC Bridge is designed to work with. Support for any format may change if a manufacturer changes it.
10. Changes and availability
- We may update, add or remove features and supported formats. If a change significantly reduces what you pay for, we will tell you in advance, and you can cancel.
- We aim to keep MC Bridge available, but we do not promise it will always be available or error-free. It may be unavailable for maintenance, updates, internet or hosting problems, or reasons outside our control.
11. Our liability to you
- Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded under the law of England and Wales.
- If you use MC Bridge for business: we are not liable for loss of profit, revenue, business, contracts, or data, or for any indirect or consequential loss. This includes the cost of rework, delays, machine downtime or wrongly placed material that results from using converted files. Our total liability to you arising out of or in connection with MC Bridge is limited to the greater of £100 and the total fees you paid us in the 12 months before the claim.
- If you are a consumer: we are responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss that was not foreseeable, or for business losses. We supply MC Bridge for domestic and private use, and in that case our total liability is limited to £100 or the fees you paid us in the 12 months before the claim, whichever is greater, unless the law does not allow this.
- Given section 6, you accept that checking converted output on site is your responsibility.
12. Suspension and termination
- You can stop using MC Bridge and ask us to close your account at any time by emailing hello@mc-bridge.com.
- We may suspend or close your account if you seriously or repeatedly break these terms, if we must do so by law, or if we stop providing MC Bridge. Where reasonable, we will give you notice first. If we close the service for reasons other than your breach, we will refund any fees you have paid for a period you have not received.
- Sections 6, 7, 9, 11 and 14 continue to apply after your account ends.
13. Changes to these terms
We may update these terms. We will show the date of the latest version at the top, and we will tell you about important changes before they take effect. If you do not agree, you can stop using MC Bridge and cancel.
14. Law and disputes
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts. Please contact us first at hello@mc-bridge.com so we can try to sort out any problem.
